Confidentiality and Mediation

What you need to know

Communications with a Family Dispute Resolution Practitioner are confidential (s 10H Family Law Act), which means that anything that is said by the parties in the mediations cannot be used outside of the mediations (such as for court purposes). There are few exceptions where our Family Dispute Resolution Practitioner may have to break confidentiality, such as:


  • to protect a child (on the reasonable belief by the practitioner);
  • to prevent or lessen a serious and imminent threat to life, health or the property of a person;
  • to report or prevent an offence involving a threat of violence or involving violence;
  • to assist the independent children's lawyer in their role; or
  • to provide a s60I certificate. 


Should by any reason our Family Dispute Resolution Practitioner believe that disclosure of the above is necessary- they will stop the mediation and discuss this with the parties.
